Welcome to mimBo! By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and mimBo. We reserve the right to update these Terms at any time, and your continued use of the platform constitutes acceptance of any changes.

2. Description of Service

mimBo is a Discord bot builder platform that provides tools and services for creating, customizing, and managing Discord bots, including:

• Command Builder for creating custom Discord bot commands
• Embed Builder for designing Discord message embeds
• Bot management and configuration tools
• Storage of user-created commands and embeds
• Integration with Discord's platform via OAuth authentication

3. User Accounts

To use mimBo, you must:

• Have a valid Discord account
• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Provide accurate and complete information when creating an account
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

4. Acceptable Use Policy

You agree to use mimBo only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Create content that violates any law or regulation
• Harass, abuse, threaten, or intimidate other users
• Create bots or commands that spam, phish, or distribute malware
• Violate Discord's Terms of Service or Community Guidelines
• Attempt to gain unauthorized access to the platform or other users' accounts
• Use the platform to distribute harmful, offensive, or illegal content
• Engage in any activity that could damage, disable, or impair the service
• Scrape, data mine, or use automated tools to access the platform without permission
• Impersonate any person or entity or misrepresent your affiliation
• Use the service to create bots that violate Discord's bot policies

5. Content Ownership and License

Your Content

You retain all ownership rights to the commands, embeds, and other content you create using mimBo ("Your Content"). By using our service, you grant us a limited, non-exclusive, royalty-free license to:

• Store and display Your Content within the platform
• Process Your Content to provide the service
• Create backups and ensure service reliability

We will never sell or share Your Content with third parties for their own use without your explicit consent.

Our Content

The mimBo platform, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the platform
• Reverse engineer or attempt to extract source code
• Remove or alter any copyright, trademark, or proprietary notices

6. Data Storage and Retention

We store the following data associated with your account:

• Discord account information (username, ID, avatar)
• Commands and embeds you create
• Usage statistics and preferences

Your created content (commands and embeds) is stored for 30 days after creation or last modification. Content may be permanently deleted after this period unless actively maintained.

7. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The platform will be available at all times without interruption
• The platform will be error-free or secure from attacks
• The results obtained from using the platform will be accurate or reliable

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

8. Discord Integration

mimBo integrates with Discord's platform. By using our service, you also agree to comply with:

• Discord's Terms of Service
• Discord's Community Guidelines
• Discord's Developer Terms of Service

We are not responsible for changes Discord makes to their platform that may affect mimBo's functionality.

9. Limitation of Liability

To the fullest extent permitted by law:

• mimBo is provided "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months (if any)
• We are not responsible for any damage to your Discord account, servers, or bot caused by using our service

10. Indemnification

You agree to indemnify and hold harmless mimBo, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you create or distribute using our platform

11. Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account remains inactive for an extended period
• We believe your actions may harm us or other users

You may terminate your account at any time by discontinuing use of the platform and requesting account deletion.

Upon termination, your right to use the service immediately ceases, and we may delete your data in accordance with our data retention policies.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using mimBo, you consent to our privacy practices as described in the Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. When we do, we will:

• Update the "Last Updated" date at the top of this page
• Notify users of significant changes via email or platform notification
• Provide a reasonable notice period before changes take effect

Your continued use of mimBo after changes to the Terms constitutes acceptance of those changes.

14. Dispute Resolution

If you have a dispute with mimBo, please contact us first at support@mimbos.com to attempt to resolve the issue informally.

Any disputes that cannot be resolved informally shall be governed by the laws of the jurisdiction in which mimBo operates, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
